These Terms of Service govern your access to and use of AustinPredict, including our website, prediction challenges, scoring systems, point systems, rankings, user accounts, content, features, and any related services we provide.

By creating an account, accessing the website, submitting predictions, using points, participating in challenges, or otherwise using AustinPredict, you agree to these Terms. If you do not agree, you must not use AustinPredict.

AustinPredict is intended to be a skill-based prediction and competition platform. AustinPredict is not intended to operate as gambling, sports betting, casino gaming, lottery, sweepstakes betting, securities trading, financial advice, or investment services.

1. Definitions

For purposes of these Terms, the following definitions apply:

• “AustinPredict,” “we,” “us,” or “our” means the AustinPredict website, platform, operators, administrators, owners, employees, contractors, and authorized representatives.
• “User,” “you,” or “your” means any person who accesses or uses AustinPredict.
• “Platform” means the AustinPredict website, systems, dashboards, prediction tools, account features, rankings, scoring tools, and related services.
• “Prediction Challenge” means any event, question, prompt, contest, forecast, or challenge hosted on AustinPredict where users submit predictions about a defined outcome.
• “Prediction” means a user’s submitted forecast, answer, selection, ranking, confidence score, probability estimate, or other response to a Prediction Challenge.
• “Points” means non-cash, non-transferable, non-refundable platform credits, score units, experience points, ranking points, or other internal measurement units used within AustinPredict.
• “Rewards” means any benefit, recognition, access, badge, rank, item, prize, or other promotional benefit that AustinPredict may offer, if any.
• “User Content” means anything submitted, posted, uploaded, displayed, transmitted, or otherwise provided by a user, including predictions, comments, usernames, profile content, images, messages, data, or feedback.
• “Official Outcome” means the final result of a Prediction Challenge as determined by AustinPredict according to the challenge rules, source data, settlement criteria, and administrative review process.

2. Eligibility

You may use AustinPredict only if you are legally permitted to do so under the laws of your location and any laws applicable to AustinPredict.

• You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher.
• You must have the legal capacity to enter into these Terms.
• You must not be barred from using AustinPredict under applicable law.
• You must not use AustinPredict from a location where prediction contests, skill competitions, points-based contests, rewards, or similar services are prohibited or restricted.
• You are responsible for confirming that your participation is lawful where you live, access the Platform, or submit predictions.

We may restrict, suspend, or terminate access based on age, location, legal requirements, risk concerns, abuse prevention, or compliance obligations.

3. Nature of the Platform

AustinPredict is designed as a prediction, analysis, ranking, and skill-based competition platform. The Platform may allow users to forecast real-world events, compare accuracy, earn points, unlock badges, climb leaderboards, and participate in structured challenges.

AustinPredict does not guarantee that any challenge, ranking, score, points balance, reward, or user performance will result in monetary value, income, profit, prize eligibility, or financial benefit.

Unless expressly stated in official written rules for a specific promotion, AustinPredict points have no cash value, no stored value, no monetary equivalent, and cannot be redeemed, exchanged, sold, transferred, withdrawn, assigned, traded, or converted into money.

4. No Gambling, Betting, or Wagering

AustinPredict is not intended to be used for gambling, betting, wagering, bookmaking, lottery activity, casino activity, or any illegal contest activity.

• You may not stake, wager, bet, risk, or deposit money or anything of value on the outcome of a Prediction Challenge.
• You may not use AustinPredict to facilitate side bets, private wagers, pooled betting, or third-party gambling activity.
• You may not sell, buy, transfer, or exchange points for money or anything of value outside the Platform.
• You may not create or participate in arrangements where users pay consideration for a chance to receive money, prizes, or anything of value based on prediction outcomes unless expressly authorized by AustinPredict and legally reviewed.
• You may not use AustinPredict in any way that violates gambling, contest, sweepstakes, lottery, sports betting, fantasy sports, securities, commodities, or financial regulations.

We reserve the right to void predictions, remove points, cancel challenges, suspend users, restrict accounts, deny rewards, or terminate access if we believe any activity resembles gambling, wagering, unlawful contest activity, market manipulation, fraud, or abuse.

5. Accounts and Security

Some features require an account. You agree to provide accurate, current, and complete information when creating or maintaining an account.

• You are responsible for keeping your login credentials secure.
• You are responsible for all activity that occurs under your account.
• You may not share, sell, rent, transfer, or assign your account.
• You may not create multiple accounts to bypass rules, gain unfair advantage, manipulate rankings, evade bans, farm points, or abuse promotions.
• You must notify us if you believe your account has been compromised.

We may require identity, age, location, payment, or account verification before allowing access to certain features, rewards, promotions, or competitive systems.

6. Prediction Challenges

Each Prediction Challenge may include its own rules, deadline, scoring method, data source, settlement criteria, eligibility restrictions, and outcome-resolution process. By entering a challenge, you agree to follow both these Terms and the challenge-specific rules.

• Predictions must be submitted before the posted deadline.
• Predictions may be locked after submission or after a designated cutoff time.
• Late, incomplete, altered, fraudulent, automated, or suspicious predictions may be rejected or voided.
• Challenge rules may vary by category, topic, scoring model, difficulty, source reliability, or administrative needs.
• AustinPredict may cancel, pause, modify, extend, reopen, or settle challenges when necessary to protect fairness, accuracy, legality, or platform integrity.

7. Scoring, Rankings, and Results

AustinPredict may use scoring systems that consider accuracy, timing, confidence, difficulty, consistency, category performance, streaks, participation history, or other performance factors.

Scores, rankings, badges, achievements, statistics, levels, titles, and leaderboard placements are for platform competition and community engagement. They are not guaranteed, permanent, or monetary.

• We may correct scoring errors at any time.
• We may recalculate rankings after corrections, audits, disputes, abuse detection, or outcome review.
• We may remove points earned through bugs, exploits, duplicate accounts, manipulation, collusion, prohibited automation, or rule violations.
• We may update scoring formulas prospectively or retroactively when needed to correct errors or preserve fairness.
• Leaderboard position does not guarantee rewards, payment, status, sponsorship, or future eligibility.

8. Official Outcomes and Settlement

AustinPredict determines the Official Outcome of each challenge using the source or settlement method stated in the challenge rules. When no specific source is listed, AustinPredict may use reasonable public sources, official announcements, reputable reporting, data providers, or administrative judgment.

• We may delay settlement if the outcome is unclear, disputed, corrected, postponed, canceled, or under review.
• We may settle a challenge as resolved, voided, partially resolved, canceled, or no-contest.
• We may correct an Official Outcome if reliable information later shows that the initial settlement was incorrect.
• We may use administrative discretion when real-world events do not match the expected challenge format.

Our determination of Official Outcomes is final unless we choose to reopen or review a result.

9. Points, Credits, and Virtual Items

AustinPredict may use points, credits, badges, rankings, virtual items, unlocks, or other platform-based units. These are limited licenses for use within AustinPredict and remain subject to our control.

• Points are not money.
• Points are not cryptocurrency.
• Points are not securities.
• Points are not stored-value cards.
• Points are not deposits.
• Points are not redeemable for cash unless expressly allowed by official written promotion rules and applicable law.
• Points cannot be sold, transferred, traded, exchanged, inherited, withdrawn, or assigned.
• Points may expire, reset, be removed, or be modified.

We may change, limit, suspend, remove, expire, adjust, or discontinue any points system at any time.

10. Purchases and Payments

If AustinPredict offers paid features, subscriptions, memberships, upgrades, entries, access passes, cosmetic items, or point packages, additional payment terms may apply.

• Prices may change at any time.
• Payments are processed by third-party payment providers.
• You agree to provide accurate billing information.
• You authorize applicable charges, taxes, and fees.
• Paid features may be non-refundable unless required by law or expressly stated otherwise.
• Purchasing access or points does not guarantee success, ranking, rewards, visibility, or challenge results.

We may refuse, reverse, cancel, or limit transactions that appear fraudulent, abusive, unauthorized, illegal, or otherwise risky.

11. Refund Policy

Unless otherwise required by law or stated in writing at the time of purchase, all purchases are final and non-refundable.

We may, at our discretion, provide refunds, credits, replacement access, or other adjustments. Any voluntary refund or adjustment does not create an obligation to provide the same treatment in the future.

12. Rewards, Promotions, and Special Events

AustinPredict may occasionally offer promotions, contests, limited events, badges, rankings, recognition, or rewards. Each promotion may have separate official rules.

• Promotions may be restricted by age, location, eligibility, account standing, or legal requirements.
• Rewards are not guaranteed unless expressly stated in official rules.
• We may substitute, modify, cancel, or withhold rewards when necessary.
• Users may be required to complete verification, tax forms, affidavits, releases, or compliance checks before receiving rewards.
• Users are responsible for taxes, reporting obligations, and legal compliance related to any rewards.

No promotion should be interpreted as gambling, wagering, or a lottery. If a promotion requires separate official rules, those rules control over these Terms for that promotion.

13. User Conduct

You agree to use AustinPredict respectfully, lawfully, and honestly.

• You may not harass, threaten, abuse, defame, stalk, intimidate, or target other users.
• You may not post hateful, violent, sexually explicit, exploitative, illegal, or harmful content.
• You may not impersonate others or misrepresent your identity.
• You may not manipulate challenges, rankings, outcomes, or scoring systems.
• You may not collude with other users to gain unfair advantage.
• You may not use bots, scripts, scrapers, automation, or artificial activity unless expressly authorized.
• You may not exploit bugs, vulnerabilities, data leaks, pricing errors, scoring errors, or system weaknesses.
• You may not interfere with servers, APIs, databases, security systems, accounts, or platform operations.
• You may not upload malware, spyware, ransomware, viruses, harmful code, or deceptive links.
• You may not use AustinPredict for spam, scams, phishing, fraud, money laundering, illegal activity, or unauthorized commercial activity.

14. Fair Play and Integrity

AustinPredict depends on fair competition. We may monitor, review, investigate, and act against behavior that threatens platform integrity.

• Duplicate accounts used to manipulate rankings may be merged, suspended, or banned.
• Coordinated manipulation may result in account termination.
• Suspicious prediction patterns may be reviewed.
• Use of leaked, confidential, illegally obtained, or non-public information may be prohibited.
• Attempts to influence real-world outcomes connected to challenges are prohibited.
• Attempts to pressure administrators, data providers, or other users are prohibited.

We may take corrective action without advance notice, including voiding predictions, removing points, freezing accounts, restricting features, or banning users.

15. User Content

You retain ownership of User Content you submit, subject to the license granted below.

By submitting User Content, you grant AustinPredict a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, display, reproduce, modify, adapt, publish, distribute, analyze, and use that content for platform operation, promotion, moderation, analytics, security, and improvement.

• You are responsible for your User Content.
• You must have the rights necessary to submit your User Content.
• Your User Content must not infringe copyright, trademark, privacy, publicity, contract, or other rights.
• We may remove, hide, edit, restrict, or moderate User Content at any time.

16. Platform Content and Intellectual Property

AustinPredict owns or licenses the Platform, including its design, text, graphics, logos, branding, software, databases, scoring systems, layouts, challenge formats, ranking systems, icons, images, and other content.

You may not copy, reproduce, distribute, modify, reverse engineer, scrape, sell, exploit, or create derivative works from AustinPredict content or systems unless expressly authorized in writing.

17. Data, Analytics, and Performance Tracking

AustinPredict may collect, generate, analyze, and display data related to predictions, accuracy, rankings, challenge activity, account behavior, device activity, and platform performance.

• We may display public profiles, rankings, badges, usernames, scores, streaks, and statistics.
• We may use aggregated or anonymized data for analytics, marketing, research, and platform improvement.
• We may use automated systems to detect fraud, abuse, duplicate accounts, bots, and suspicious activity.
• We may preserve records when needed for legal, security, compliance, dispute, or operational purposes.

18. Privacy

Your use of AustinPredict is also governed by our Privacy Policy. The Privacy Policy explains how we collect, use, disclose, store, and protect information.

If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls only for that privacy-specific issue.

19. Third-Party Services

AustinPredict may integrate with third-party services, including payment processors, analytics providers, hosting companies, data providers, social login services, email services, advertising networks, security providers, and content services.

We are not responsible for third-party services, websites, data, outages, fees, policies, security, content, decisions, or actions. Your use of third-party services may be governed by separate terms and privacy policies.

20. No Financial, Legal, Tax, Betting, or Investment Advice

AustinPredict may include discussions, predictions, market-related topics, public events, economic questions, sports topics, political topics, or other real-world subjects. All content is for informational, entertainment, analytical, and competitive purposes only.

• We do not provide financial advice.
• We do not provide investment advice.
• We do not provide legal advice.
• We do not provide tax advice.
• We do not provide gambling advice.
• We do not recommend buying, selling, trading, staking, wagering, or investing based on Platform content.

You are solely responsible for your own decisions outside the Platform.

21. Availability and Platform Changes

We may update, modify, suspend, limit, or discontinue any part of AustinPredict at any time.

• We do not guarantee uninterrupted access.
• We do not guarantee that challenges will always be available.
• We do not guarantee that points, rankings, or features will remain unchanged.
• We may perform maintenance, updates, security changes, or emergency shutdowns.
• We may remove or change features for legal, business, technical, or operational reasons.

22. Errors, Bugs, and Exploits

If you discover an error, bug, exploit, vulnerability, scoring issue, incorrect settlement, or unintended feature, you must report it and stop using it.

• You may not profit from bugs or exploits.
• You may not share exploit methods publicly.
• You may not access systems without authorization.
• We may reverse transactions, remove points, void predictions, or suspend accounts connected to exploit activity.

23. Account Suspension and Termination

We may suspend, restrict, or terminate your account or access to AustinPredict at any time if we believe you violated these Terms, created legal risk, abused the Platform, harmed other users, manipulated systems, or engaged in suspicious activity.

Upon termination, your right to use AustinPredict ends immediately. Points, rankings, badges, virtual items, access, and platform privileges may be removed without compensation unless required by law.

24. Disputes and Appeals

If you believe a score, prediction result, account action, or challenge settlement was incorrect, you may contact AustinPredict support within the timeframe stated in the applicable challenge rules. If no timeframe is stated, disputes should be submitted within seven days of the relevant decision.

• Appeals must include your username, challenge name, prediction details, reason for dispute, and supporting evidence.
• We may request additional information.
• We may deny incomplete, abusive, repetitive, or late disputes.
• Our final appeal decision is binding for Platform purposes.

25. Communications

By using AustinPredict, you agree that we may send you service-related communications, including account notices, security alerts, challenge updates, policy updates, moderation notices, transaction notices, and administrative messages.

Marketing communications may be subject to separate consent and opt-out options where required by law.

26. Copyright Complaints

If you believe content on AustinPredict infringes your copyright, contact us with sufficient information to identify the work, the allegedly infringing material, your contact information, and a statement that you believe the use is unauthorized.

We may remove or disable access to allegedly infringing content and may terminate repeat infringers where appropriate.

27. Disclaimers

AustinPredict is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and security.

• We do not guarantee that predictions will be accurate.
• We do not guarantee that user rankings reflect future performance.
• We do not guarantee that source data will be error-free.
• We do not guarantee that the Platform will be uninterrupted or secure.
• We do not guarantee any financial, competitive, reputational, or personal outcome.

28. Limitation of Liability

To the maximum extent permitted by law, AustinPredict and its owners, operators, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from or related to your use of the Platform.

To the maximum extent permitted by law, our total liability for any claim related to AustinPredict will not exceed the greater of: (a) the amount you paid to AustinPredict in the three months before the claim arose, or (b) $100.

29. Indemnification

You agree to defend, indemnify, and hold harmless AustinPredict and its owners, operators, employees, contractors, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of AustinPredict.
• Your violation of these Terms.
• Your User Content.
• Your violation of law.
• Your violation of another person’s rights.
• Your fraud, abuse, manipulation, or misconduct.

30. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, unless applicable law requires otherwise.

You agree that disputes will be handled in the state or federal courts located in Florida, unless applicable law requires a different forum.

31. Changes to These Terms

We may update these Terms at any time. When we update them, we may change the “Last Updated” date, post notice on the Platform, send notice by email, or provide notice through your account.

Your continued use of AustinPredict after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using AustinPredict.
